Reporting & Complaint System

These Terms of Use govern access to and use of the online reporting and complaint system (the “Reporting System”) operated by Pink Ribbon Inc., doing business as PinkRibbon International (“we,” “our,” or “us”).
By submitting a report through this system, you agree to these Terms.
1. Purpose of the Reporting System
The Reporting System is provided to allow individuals to report in good faith:
- Misconduct
- Safeguarding concerns
- Fraud or financial wrongdoing
- Governance violations
- Pinkwashing
- Unauthorized use of the PinkRibbon International name or logo
- Ethical or legal concerns related to PinkRibbon International or its affiliates
This system is intended for serious concerns related to PinkRibbon International’s operations, programs, brand, or personnel.
2. Good Faith Requirement
All reports must be submitted in good faith. By submitting a report, you confirm that:
- The information provided is true and accurate to the best of your knowledge.
- You are not knowingly submitting false, misleading, defamatory, or malicious information.
- The report is not being used for harassment, retaliation, or personal disputes unrelated to PinkRibbon International’s governance or safeguarding.
PinkRibbon International reserves the right to take appropriate action in cases of knowingly false or abusive submissions.
3. Not for Emergencies
The Reporting System is not an emergency service. If you believe someone is in immediate danger, contact local emergency services or law enforcement.
PinkRibbon International does not provide crisis counseling, medical services, or emergency intervention through this platform.
4. Confidentiality & Anonymity
Reports may be submitted anonymously. PinkRibbon International will:
- Treat reports confidentially to the extent reasonably possible.
- Share information only with individuals who have a legitimate need to know.
- Take reasonable measures to protect the identity of reporting persons.
However, confidentiality cannot be absolutely guaranteed, particularly where:
- Disclosure is required by law.
- Legal proceedings arise.
- Law enforcement involvement becomes necessary.
5. No Attorney-Client or Advisory Relationship
Submission of a report does not:
- Create an attorney-client relationship.
- Create a contractual relationship.
- Guarantee investigation or specific outcomes.
- Create a duty of care beyond applicable law.
PinkRibbon International reserves sole discretion regarding the handling, investigation, and resolution of reports.
6. Data Protection & Privacy
Personal information submitted through the Reporting System will be processed in accordance with:
- PinkRibbon International’s Privacy Policy
- Applicable U.S. federal and New York State laws
- GDPR (where applicable)
- Other relevant international data protection regulations
By submitting a report, you consent to the processing and storage of your information for compliance, safeguarding, and investigative purposes.
7. Intellectual Property & Brand Protection Reports
If submitting a report regarding pinkwashing, unauthorized use of the PinkRibbon International logo, trademark infringement, or false affiliation claims, you acknowledge that:
- PinkRibbon International may pursue enforcement actions at its discretion.
- Submission of a report does not entitle you to legal standing or involvement in enforcement actions.
- PinkRibbon International may decline to act based on legal assessment.
8. Limitation of Liability
To the fullest extent permitted by law:
- PinkRibbon International shall not be liable for any direct, indirect, incidental, or consequential damages arising from the use of the Reporting System.
- PinkRibbon International makes no guarantees regarding investigation timelines or outcomes.
- PinkRibbon International is not responsible for technical failures, submission errors, or incomplete transmissions.
9. Jurisdiction & Governing Law
These Terms shall be governed by the laws of the State of New York, United States, without regard to conflict-of-law principles. Any disputes arising in connection with these Terms shall be subject to the exclusive jurisdiction of courts located in New York.
10. Modifications
PinkRibbon International reserves the right to modify these Terms at any time. Updated versions will be posted with a revised effective date. Continued use of the Reporting System after changes constitutes acceptance of the revised Terms.
